THE RECENT execution-style murders of three college students in Newark have shocked and horrified residents of our state. The subsequent arrest of an illegal immigrant who had a history of previous charges for rape and assault has only added to the outrage. New Jerseyans are asking how it is possible that someone with no legal right to be in our country and who has a history of arrests for violent crimes could be allowed to roam free to prey on law-abiding residents.

Portchester NY is sued by US Justice Department PORT CHESTER, N.Y., Dec. 15 — The United States Justice Department filed a lawsuit on Friday against this Westchester County village, charging that its at-large voting system illegally diminishes Hispanic influence.
The suit, which contends that the system violates the Voting Rights Act, seeks an injunction that could scuttle Board of Trustees elections in March.

To abide by the Voting Rights Act of 1965, the federal government proposed a redictricting plan for Port Chester. The Village Board of Trustees passed a resolution on December 4, 2006 saying that they don't agree with the Department of Justice's decision that they must reform the election system. Federal authorities believe that the Village's "at large" voting system denies Hispanics representation on the board of trustees. According to Reuters, "All voters in town elect each board member, whereas dividing the town into six electoral districts would give Hispanics a majority in at least one of them because they are largely concentrated in one area of town, the suit said."

Loitering and Conduct in Public Places: In addition to the preemption of municipal loitering ordinances, a January 2003 decision of the Appellate Division of the NJ Superior Court [State of New Jersey (Township of West Orange) vs. Carl A Paserchia] ruled that N.J.S.A. 2C: 33-1 to 28 reveals a state "policy to comprehensively address street behavior and other conduct in public places which may disturb citizens and disrupt peaceful society."
Criminal History Record Check: Many municipalities have enacted ordinances providing for criminal history record checks. Chapter 199 of the Laws of 2003 was enacted to bring various state statutes into compliance with federal law. As part of that act, municipalities were specifically given the authorization to receive information from the FBI and to enact an ordinance providing that "an authorized municipal official or officer may request a criminal history record background check of any person for an official governmental purpose, including, but not limited to, employment, licensing and the procurement of services."
